Mass. DUI Hardship Licenses

MASS_DUI_HARDSHIP_LICENSEDrivers whose licenses are suspended in Wayland Massachusetts can be considered for a 12 hour hardship license, which is also known as a Cinderella license, work license, 7 to 7 license, or temporary restricted license. There is absolutely no automatic entitlement to a Wayland MA hardship license and the two sources of such licenses, the Registry and Board of Appeal, have wide latitude and discretion when it comes to issuing hardship licenses. Both agencies require hardship license applicants to provide certain documents and meet certain requirements.

Individuals can be considered for hardship licenses, for work, education, or medical reasons, based on the following schedule.

DUI Offense Minimum Hardship License Waiting Period
1st Offenders granted ยง 24D dispositions as soon as the case is resolved and the Registry is notified of the resolution.
2nd Offense DUI must serve 1 year of the 2 year DUI license suspension.
OUI 3rd Offense must serve 2 years of the 8 year DUI revocation.
4th Offense DUI must serve 5 years of the 10 year revocation.
5th Offense DUI revoked for life with no possibility of hardship relief.

Also, those who refuse to submit to a breathalyzer test with three (3) prior DUI convictions will be revoked for life with no possibility of hardship relief. However, you may be able to appeal this breath test refusal suspension.

Melanie's Law requires that repeat DUI offenders must use an ignition interlock device during the entire length of any hardship license and for 2 years thereafter.

Out of state drunk driving offenses generally count towards license suspension periods and it does not matter whether or not the prosecution was able to prove prior drunk driving convictions, beyond a reasonable doubt at trial, or whether the judge treated you as a lesser offender. When calculating the length of a DUI or breathalyzer refusal suspension, the official records of the Registrar are what controls.

Many purported DUI lawyers are unaware of how the Registry operates and how it will treat DUI and other criminal convictions and pleas. Fortunately, Attorney Brian E. Simoneau has established himself as an authority on Mass. license suspensions and revocations. He often advises and assists DUI defendants and their lawyers in matters involving the Registry.
